 "Emerging Normativities: Creative Complicity at the New Governance Frontier" 

Introduction

This talk looks closer at political experimentation and jurisdictional design at what is increasingly referred to as the new governance frontier. Leaving aside the historicity every presumed “newness” carries within, contemporary phenomena such as climate change (and its differential materialization), raging political and military conflicts, growing mistrust in  in representational governments, and the return to authoritarian regimes are indeed radically shifting the physical and social conditions of existence on planet Earth, opening up frontier spaces in which the question of what it means to govern and being governed is renegotiated. As Rassmusen and Lund pointedly argue, frontier dynamics dissolve existing social orders—property systems, political jurisdictions, rights, and social contracts. Intensifying these dynamics is digital technology, particularly blockchain, which has the potential to revolutionize not only the means of production but also those of value creation, offering unprecedented possibilities for redefining governance. From Palau to Zanzibar, Puerto Rico to Nevada, and Slovenia to Thailand and Taiwan, network states, Web3 pop-up cities, and community DAOs are not only being conceptualized but also implemented on the ground. This presents a critical challenge for legal theorists and thinkers: either leave the future of law and governance to others or navigate the complicities to create concepts that can withstand the realities forming outside academic walls, journals, blog posts, and discourses. In conclusion, I wish to introduce the Decentralized Right to Breathe initiative as an example of how the latter approach can be realized. 

Biographical note

Daniel Gandorfer is a lecturer at University of Westminster. Daniela’s research focuses on scientific and technological frontier spaces — such as quantum physics,  blockchain technology & Web3, and psychedelics — and their implications for emerging modes of normativity and governance. She is the recipient of the 2021 ASciNA Young Scientist Award, and has co-edited the Research Handbook in Law and Literature (Edward Elgar Publishing, with Peter Goodrich and Cecilia Gebruers). Daniela is co-editor of the "Discourses of Law" book series (Routledge), editorial board member of the "Law and Literature Journal (Taylor & Francis), and deputy director of the Westminster Law and Theory Lab.
